This policy applies to you if you are an individual. You may be a customer, agent, supplier, consultant, contractor or job applicant.
ABOUT THIS POLICY
At Fieldforce Services Pty Ltd (Fieldforce), protecting your privacy and the confidentiality of your personal information is very important. Personal information is information we have about you from which your identity is either apparent to, or can be reasonably determined by, us. When you give us your personal information, it imposes a serious responsibility upon us to protect your personal information and maintain your trust.
This Privacy Policy describes the information that may be collected when you deal with us, the choices you can make about how your personal information is used, how we protect your personal information and other relevant matters.
We believe that our privacy and information handling practices comply with the:
- National Privacy Principles ("NPPs") contained in the Privacy Act 1988 (Cth) in relation to our commercial activities;
- Information Privacy Principles ("IPPs") contained in the Privacy Act 1988 (Cth) in relation to our non‐commercial activities; and
Should there be a conflict between the IPPs and NPPs, Fieldforce adopts the obligation which protects your privacy the most.
Fieldforce will follow any guidelines issued by the Federal Privacy Commissioner in applying this policy or as necessary to comply with the Privacy Act 1988 (Cth)
WHY WE COLLECT PERSONAL
INFORMATION
AND HOW WE MAY USE IT
Generally, Fieldforce will collect personal information directly from you, or from a third party, only to the extent necessary to provide a Fieldforce product or service, to comply with a contractual requirement such as part of a tender and/or to carry out our internal administrative operations.
Generally, we may collect personal information from you in situations such as when you:
- Fill in an application form;
- Deal with us over the telephone;
- Email us;
- Ask us to contact you after visiting our website; or
- Have contact with us in person
We will collect personal information from you, or a third party, by lawful and fair means and not in an unreasonably intrusive way. You may also deal with us anonymously where this is lawful and practicable.
You may choose not to supply information requested by us, however our ability to assist you may be restricted.
NOTICE
When we collect your personal information either directly from you or from a third party, we will take reasonable steps to make you aware of the following things:
- The purpose/s for which it may be used;
- If it might be disclosed to third parties, and if so, the names of those parties;
- If the collection of your information is authorised or required by the law, the name of that law;
- The fact that you may request access to your information; and
- The consequences (if any) should you choose not to provide your information.
USE
Fieldforce will use your personal information for a purpose only for which it is relevant. This means we will use your personal information only for the particular purpose that you provided it, or for a directly related purpose. Sometimes, we may also use your personal information for a related purpose where that other use is:
- Required or permitted by law; or
- With your express or implied consent.
From time to time we may use your personal information to identify particular Fieldforce products and services which we believe may be of value and interest to you. We may then contact you to let you know about these products and services and how they may benefit you.
TELEMARKETING
On occasions, Fieldforce may engage in telemarketing activities with our consumer customers. Should any consumer telemarketing be done or authorised by Fieldforce, and to the extent applicable, we will comply with the:
- Do Not Call Register Act 2006 (Cth);
- Do Not Call Register (Consequential Amendments) Act 2006 (Cth);
- Telecommunications (Do Not Call Register)(Telemarketing and Research Calls) Industry Standard 2007.
You may instruct us at any time to remove any previous consent you provided to receive marketing communications from us.
INFORMATION SHARING
We have a strict duty to keep confidential and private all personal information we hold about you. However, certain exceptions to this duty apply. For example, where disclosure of your personal information is:
- Authorised or required by law
e.g. disclosure to various government departments and agencies such as the Australian Taxation Office, CentreLink, Child Support Agency or disclosure to courts under subpoena. In these circumstances we may be compelled to disclose your personal information, while on other occasions we may exercise our discretion to disclose your information subject to certain legal constraints, e.g. where disclosure is reasonably required for enforcement of the criminal law; - In the public interest
e.g. where a crime, fraud or misdemeanour is committed or suspected and disclosure against the customer's rights to confidentiality seems justified; - With your consent
Your consent may be implied or express and it may also be verbal or written
USE OF THIRD PARTY SERVICE PROVIDERS
When we temporarily provide personal information to companies who are contracted to perform services for us or on our behalf, such as contractors, we will require those companies to protect your personal information as diligently as we do. Strict contractual, technical and other quality assurance measures are used to ensure your personal information is protected in accordance with this Privacy Policy and the Privacy Act 1988 (Cth).
ACCESS TO YOUR INFORMATION
Fieldforce will, upon your written request, and subject always to applicable privacy laws:
- Provide you with access to your personal information which is held by us. However, we ask that you identify, as clearly as possible, the type/s of information requested;
- Deal with your request to provide access to your personal information in a reasonable time‐ usually within 30 days of receipt of your request;
- Not charge you for making such a request, but we may recover from you our reasonable costs incurred in supplying you with access to this information.
EXCEPTIONS
Your right to access your personal information is not absolute. In certain circumstances, the law permits us to refuse your request for access to your personal information, such as where:
- Access would pose a serious threat to the life or health of any individual;
- Access would have an unreasonable impact on the privacy of others;
- The request is frivolous or vexatious;
- The information relates to a commercially sensitive decision making process;
- Access would be unlawful; or
- Access may prejudice enforcement activities, a security function or commercial negotiations.
INFORMATION SECURITY
Fieldforce is committed to keeping your trust by protecting and securing your personal information. We will:
- Employ appropriate technical, administrative and physical procedures to protect your personal information from unauthorised disclosure, loss, misuse or alteration;
- Limit access to your personal information to those staff with a business need to know and employing the principle of 'least privilege' when granting access to systems or records containing personal information;
- Keep personal information only for as long as the law requires;
- Subject to applicable laws, take reasonable steps to destroy your personal information if it is no longer needed for the particular purpose for which it was originally collected.
DATA QUALITY
When collecting, using or disclosing your personal information Fieldforce will take reasonable steps to ensure your information is accurate, complete and up‐to‐date.
